Direct Awards

The Tribal 8(a) Advantage

Seneca Nation Group’s tribally owned, SBA-certified 8(a) companies provide federal agencies with a streamlined acquisition pathway for mission-focused products and services. Under the Small Business Act and applicable SBA and FAR regulations, agencies may pursue sole-source awards to qualified tribally owned 8(a) participants, subject to SBA acceptance and applicable acquisition requirements.

Authorities: 15 U.S.C. § 637(a); 13 CFR § 124.506(b); RFO FAR 19.108-7.

authority benefits

Tribal 8(a) Authority Benefits

Flexible Award Authority

Individually owned 8(a) firms generally cannot receive sole-source awards above the 8(a) competitive thresholds ($5.5 million; $8.5 million for manufacturing). Tribally owned 8(a) participants can. Civilian agencies may award up to $30 million, and DoW agencies up to $100 million, without a Justification and Approval (J&A). Larger awards require a streamlined J&A and have no dollar cap. All thresholds are based on the anticipated total contract value, including options.

Authorities: 13 C.F.R. § 124.506(b); RFO FAR 6.103-5(e), 6.104-1(b), and 19.108-7(a)(2), (b); DFARS 206.104-70 (Class Deviation 2026-O0017).

Limited Protest Exposure

Competitors cannot challenge the selected participant's 8(a) eligibility, its size, or the NAICS code assigned to a sole-source 8(a) requirement; those questions belong to SBA. GAO also will not review an agency's decision to place a requirement in the 8(a) program absent a showing of possible bad faith or a regulatory violation.

Authorities: 13 C.F.R. § 124.517(a), (b), (d)(1); 4 C.F.R. § 21.5(b)(1), (b)(3); RFO FAR 19.103(d)(2)(i).

Speed and Efficiency

Sole-source procedures can reduce acquisition lead time and support the timely delivery of mission-critical products and services. SBA decides whether to accept a sole-source requirement within 10 working days (two working days at or below the simplified acquisition threshold).

Authorities: RFO FAR 19.108-4(c)(1).

Direct Negotiations

After SBA accepts a sole-source requirement, it may authorize the contracting officer to negotiate directly with the selected participant on scope, technical approach, schedule, and fair market price. Where SBA has delegated contract execution to the agency through a Partnership Agreement, the agency awards directly to the participant.

Authority: RFO FAR 19.108-1(d), 19.108-4(c)(3), and 19.208-4; DFARS 219.108-1 (Class Deviation 2026-O0037).

Small Business Goal Credit

A single award to one of SNG’s 8(a) companies earns double credit: it counts toward the agency's small business goal and its small disadvantaged business goal.

Authority: 15 U.S.C. § 644(g); RFO FAR 19.101(a); SBA Goaling Guidelines.

Teaming and Collaboration

Seneca Nation Group's family of companies brings together diverse capabilities and specialized knowledge to develop tailored solutions that advance each customer's mission.

award process

How to Direct Award to an SNG Tribal 8(a) Company

The Tribal 8(a) sole-source process can be completed through seven coordinated steps, with clear responsibilities for the agency, SBA, and selected SNG company.

1

Define the Requirement

Government Program Office

Develops the statement of work or performance work statement and identifies the required outcomes, anticipated value, period of performance, NAICS code, and acquisition schedule.

2

Identify an SNG 8(a) Company

Contracting Officer, with SNG Support

Conducts market research and identifies an SNG 8(a) company whose capabilities, experience, capacity, and active 8(a) status align with the requirement. Contact SNG for assistance identifying the company best suited to support your agency’s needs.

Authority: RFO FAR 19.108-3; 13 C.F.R. § 124.109(c)(3)(ii)(A)

3

Confirm Funding and Approvals

Government Acquisition Team

Confirms funding and completes the required acquisition planning, internal reviews, and any applicable Justification and Approval.

4

Submit the Requirement to SBA

Contracting Officer

Submits an offering letter to the SBA district office servicing the selected SNG company and identifies that company as the proposed awardee. The offering letter must identify the proposed awardee and include the applicable information required by RFO FAR 19.108-4(b)(1).

Authority: RFO FAR 19.108-4(b)(1).

5

Obtain SBA Acceptance

Small Business Administration (SBA)

The SBA determines whether to accept the requirement and provides its written decision within 10 working days for contracts likely to exceed the SAT and within two working days for contracts at or below the SAT, unless an extension is granted. The SBA also identifies who will conduct negotiations.

Authority: RFO FAR 19.108-4(c).

6

Request, Evaluate, and Negotiate the Proposal

Contracting Officer and Selected SNG Company

The Government requests a proposal, the selected company responds, and the parties negotiate the scope, schedule, terms, and fair market price. SBA provides the required concurrence or approval.

Authorities: RFO FAR 19.208-2 through 19.208-4.

7

Finalize and Award

Contracting Officer and SBA

Completes the contract documentation and required approvals, then executes the award using the applicable SBA and agency procedures.

Authority: RFO FAR 19.208-7.
